# WILL I PAY MORE WITH STATE FARM AT AN OUT-OF-NETWORK SHOP?

Quick Answer

As a rule, no — and the warning that you will is a steering nudge, not a bill. Your State Farm policy pays to repair your car to its pre-loss condition at the shop you choose. Texas law puts that choice with you (Tex. Ins. Code §1952.301), and §1952.302 bars an insurer from requiring a particular shop — State Farm’s own claims page says you “can choose any shop you like.” Select Service is simply their network of shops that signed pricing agreements with them; it’s a recommendation, not a requirement, and going outside it doesn’t raise your out-of-pocket — your deductible is still your deductible, once. A reputable independent bills at market rates and documents its supplements, so the “you’ll pay the difference” implied by the warning gets settled on paper, not on your invoice. In our own State Farm claim files, every out-of-network repair was approved and honored.

## WHAT THE WARNING ACTUALLY MEANS — AND WHAT THE LAW SAYS BACK

“You’ll pay more if you don’t use one of our shops” sounds like a fee schedule. It isn’t — it’s a steering line, and Texas drew a bright line around it. Under §1952.301 the choice of repair shop is yours, and §1952.302 says an insurer may not require you to use a particular shop — it can recommend, but it can’t cross into “state or suggest” that you have to. State Farm’s own claims materials say it plainly: you “can choose any shop you like to repair your vehicle’s damage.” Select Service is their program of shops that have pricing and workflow agreements with them — genuinely a convenience, and genuinely optional. Choosing a shop outside it doesn’t change what your policy owes: the reasonable cost to return your car to its pre-loss condition, minus your deductible, once.

So where could a “difference” even come from, honestly? Two places, and neither has to land on you. First, carriers pre-negotiate labor rates and pre-agree to [guarantee the work](https://dgcollision.com/answers/insurance-wont-guarantee-repairs-at-my-shop/) at network shops — that’s a convenience for them, not an obligation on your wallet. Second, a real gap only appears if a shop bills above prevailing market rate and you agree to cover the overage. A reputable independent doesn’t create that situation: it bills at market rates, writes OEM-procedure supplements the adjuster can read, and works the number with State Farm directly — which is why the [out-of-network warning](https://dgcollision.com/answers/will-i-pay-more-at-an-out-of-network-body-shop/) is a forecast, not a receipt. Our standing position is simpler still: any rate gap is ours to resolve with the carrier, never transferred to the customer.

Here’s the part we can speak to first-hand. Across our own State Farm claim files, State Farm promotes Select Service more persistently than any other carrier we bill — which is lawful recommendation, not coercion — and in every one of those files the out-of-network repair was approved, supplemented where the teardown required it, and the choice held. The receipts, with sample sizes, are in our [State Farm claims shop report](https://dgcollision.com/guides/state-farm-claims-shop-report/), and the claim-process detail lives on the [State Farm body shop page](https://dgcollision.com/state-farm-body-shop-lewisville/). If a recommendation ever shades into pressure, §1952.304 bars the gag-clause version of it and the Texas Department of Insurance takes complaints (TDI bulletin B-0031-10 spells out the rules). None of that is a fight you have to have, though — bring us the claim number and a photo, and the shop choice stays yours while the paperwork becomes ours.

## ASKED ALONGSIDE THIS ONE

Does State Farm actually pay less if I skip Select Service? +

A: No — your policy pays the reasonable cost to repair the car to its pre-loss condition wherever you choose, and your deductible is the same either way, paid once. Select Service shops have pre-set pricing agreements, which is a workflow convenience for the carrier, not a discount you forfeit by going elsewhere. A proper independent repair is billed at market rates and documented to the adjuster.

Can State Farm require me to use one of their shops? +

A: No. Tex. Ins. Code §1952.301 gives you the shop choice and §1952.302 bars an insurer from requiring a particular shop — the ceiling is “recommend,” not “state or suggest” that you must. State Farm’s own claims page says you can choose any shop you like. A recommendation is fine and normal; a requirement isn’t allowed.

What if my shop’s labor rate is higher than State Farm’s? +

A: That’s the honest nuance, and it rarely reaches you. A gap only becomes your cost if a shop bills above prevailing market rate and you agree to cover it. We bill at market rates and document any supplement with the OEM procedure behind it, then work the number with State Farm directly. Our position is that a rate gap is ours to resolve with the carrier, not something we pass to you.

Will the repair take longer or lose its guarantee out of network? +

A: Not here. Our published claim files show approvals in the same window network shops see, and our [timeline answer](https://dgcollision.com/answers/does-a-claim-take-longer-at-a-non-network-shop/) covers why. On the guarantee: the carrier never repairs your car — the shop does, so the warranty that matters is the shop’s. Ours is a written lifetime warranty that travels with the car regardless of anyone’s network.
