TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of the website dgcollision.com (the "Site") and the repair and body shop services provided by DG Collision Center ("DG Collision," "we," "our," or "us") at 693 Metro Park Cir, Lewisville, TX 75057. By using the Site or engaging our services, you agree to these Terms. If you do not agree, please do not use the Site or engage our services.

Acceptable Use of the Site

The Site is provided for informational purposes, to request estimates, and to contact us. You agree not to:

• Use the Site in any way that violates applicable federal, state, or local law
• Attempt to gain unauthorized access to any portion of the Site or underlying systems
• Interfere with or disrupt the Site, including by introducing viruses, overloading forms, scraping at excessive rates, or abusing submission forms
• Submit false, misleading, or fraudulent information through any form on the Site
• Use the Site to harvest or collect information about other users

Estimates Are Not Binding Quotes

Any estimate, cost range, turnaround time, or pricing information provided — whether on the Site, over the phone, via text, or in writing — is an estimate based on the information available at the time, not a binding contract or fixed quote. Actual repair cost and timeline depend on:

• Hidden damage discovered during teardown
• Parts availability, backorders, and supplier pricing
• Insurance carrier approval, supplement negotiations, and parts-type decisions (OEM vs aftermarket)
• Scope changes requested by you during the repair
• Pre-existing conditions on the vehicle unrelated to the incoming damage

We will communicate any material change to the estimate before performing additional work beyond the initial approved scope.

Repair Authorization & Payment

All repair work requires signed authorization from the vehicle owner or authorized party before work begins. Authorization may be signed in person, electronically, or — in cases where your insurance carrier is directing the repair — via the carrier's standard direction-of-pay agreement.

Payment is due upon completion of the repair and before the vehicle is released, unless a specific alternate arrangement is made in writing. For insurance claims, the insurance carrier's direct payment or the customer's deductible (as applicable) is due at release. Accepted payment methods: cash, credit card, check, and insurance-direct payment.

Vehicles left on our premises more than 30 days after repair completion without communication may be subject to storage fees and mechanic's lien procedures under Texas law.

Warranty

DG Collision Center provides the following workmanship warranties on repairs we perform:

• Lifetime warranty on paint and refinish workmanship for as long as you own the vehicle — covers peeling, cracking, and manufacturer-defect issues related to our application
• Lifetime warranty on structural repair workmanship performed at our shop — covers the labor and process of our repair, subject to the exclusions below
• 12-month warranty on mechanical components we install as part of a collision repair, or the manufacturer's warranty on the part, whichever is longer

Exclusions apply — our warranties do not cover:

• Damage from subsequent accidents, collisions, or impacts
• Normal wear and tear, rock chips, environmental damage (hail, flooding, fire)
• Rust or corrosion originating from pre-existing conditions or from damage not disclosed at the time of repair
• Parts we did not supply
• Modifications to the vehicle made by you or a third party after the repair
• Vehicles transferred to a new owner (our workmanship warranty is not transferable unless separately agreed in writing)

Warranty claims must be submitted to DG Collision Center for inspection before repair. We will not reimburse third-party repairs performed without our prior authorization.

Insurance Claims

Under Texas Insurance Code §1952.301, you have the right to choose the repair facility for your vehicle — your insurer cannot require you to use a specific shop. We handle insurance claims with all major carriers (State Farm, GEICO, Progressive, Allstate, USAA, Farmers, Liberty Mutual, Nationwide, Travelers, Tesla Insurance, and others).

You remain responsible for your policy deductible (minus any deductible assistance we have specifically offered in writing), any costs not covered by your policy, and any upgrades beyond the carrier-approved scope that you specifically request.

If a carrier and DG Collision disagree on the necessary repair scope or parts, we will advocate for OEM-procedure-compliant repair using documented position statements. The final repair decision, however, is between you and your carrier.

Deductible Assistance

DG Collision Center may offer deductible assistance of up to $1,000 on qualifying repairs. Deductible assistance is a promotional discount applied against your total repair cost, offered at our discretion. It is not an insurance rebate, insurance fraud, or a payment from or to any insurance carrier — it is a legitimate price discount applied to the customer-owed portion of a legitimate repair. Availability and terms may change without notice.

Hail-Repair $0 Out-of-Pocket Promotion

Where advertised, our $0 out-of-pocket hail repair promotion applies only to qualifying comprehensive-insurance hail claims. "Qualifying" means:

• You have comprehensive insurance coverage active at the time of the hail event
• The hail damage is covered by your policy
• Your deductible does not exceed the deductible-assistance amount we offer for that claim
• The claim is for hail damage only — not combined collision damage

Specific terms, including current deductible-assistance maximum, are provided in writing at the time of estimate. Not all claims qualify. Contact us for specifics on your claim.

No Medical, Legal, or Insurance Advice

Information on the Site — including Texas insurance-law notes, post-accident guidance, and repair explanations — is provided for general educational purposes and is not legal, medical, or professional insurance advice. Consult a licensed professional for advice specific to your situation.

Intellectual Property

The Site and its content (text, images, logos, designs) are owned by DG Collision Center or used with permission and are protected by U.S. copyright and trademark law. You may view and share Site content for personal, non-commercial use. Reproducing Site content for commercial purposes without written permission is prohibited.

Third-party trademarks referenced on the Site (Tesla, Ford, Honda, Toyota, BMW, Mercedes-Benz, PPG, I-CAR, etc.) are the property of their respective owners. DG Collision Center is not affiliated with, endorsed by, or approved by these manufacturers unless specifically noted.

Limitation of Liability

To the fullest extent permitted by Texas law, DG Collision Center's liability for any claim arising out of or related to the Site or our services is limited to the amount you paid us for the specific repair or service at issue. We are not liable for indirect, incidental, consequential, punitive, or special damages — including loss of use, loss of income, loss of vehicle value, or emotional distress — even if we have been advised of the possibility of such damages.

Nothing in these Terms limits liability that cannot lawfully be limited under Texas law, including liability for gross negligence, willful misconduct, or fraud.

Indemnification

You agree to indemnify and hold harmless DG Collision Center and its owners, employees, and agents from any claim arising from your violation of these Terms, your misuse of the Site, or your submission of false or fraudulent information.

Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any legal action arising under these Terms or related to our services must be filed in a court of competent jurisdiction located in Denton County or Dallas County, Texas. You consent to personal jurisdiction and venue in those courts.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be announced on the Site. Your continued use of the Site or our services after changes are posted constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full effect.
