There is no Texas statute that forbids a shop from choosing not to collect part of what a customer owes the shop. What the law does forbid — and this is Texas Penal Code §35.02, insurance fraud — is lying to the carrier: inflating the estimate, invoicing work that wasn’t done, or misrepresenting the loss so the insurance payout secretly covers the deductible you were told would “disappear.”
